DECLARATION OF CONSENT DATA PROTECTION
1. General
1.1. With this declaration of consent, I (hereinafter referred to as the “User”) agree that my personal data specified below, which is collected on the basis of the time recording and payroll accounting application for mobile devices as well as for stand-alone devices of United DK Software DMCC (hereinafter referred to as the “Application” or “United-Software”), will be collected, processed, transmitted, transferred, used, evaluated, stored and protected (hereinafter referred to as “collected, processed and transmitted”) in accordance with the following provisions and for the following purposes and in accordance with the EU General Data Protection Regulation (hereinafter referred to as “GDPR”) and the Data Protection Act as amended.
1.2 This declaration of consent is accepted by the user by placing a “check mark” or by “clicking” on the corresponding check box in the application to be used for mobile devices as well as for stand-alone devices.
1.3 United-Software protects stored data in accordance with the statutory provisions, in particular – if applicable to the system – in compliance with Art. 24, 25 and 32 DSGVO. However, United-Software shall not be liable for unlawful interference by third parties (e.g. through hacking, viruses, etc.).
2. Types of data
2.1 The following data may be collected, processed and transmitted in accordance with the provisions of this declaration of consent, provided that they are stored in the United-Software application:

2.2 The following sensitive data may be collected, processed and transmitted in accordance with the terms of this consent form, provided that it is stored in the United software application:

2.3 The following access data may be collected, processed and transmitted in accordance with the provisions of this declaration of consent, provided that they are performed as an action in the United software application:
Actions performed such as saving, reading, editing and deleting data within the application.
Time at the time of the action

Source and reference to the actions and accesses
Browser used
Operating system used
Used IP address
3. Data processing
3.1 The data will be processed for the following purposes:
Storage
Working time recording and control
(Automated) payroll accounting **
Statistical analysis and improvement of the application
Locating the user, but without the possibility of creating a “movement profile”, i.e. any changes in the user’s location cannot be (re)tracked
Marketing, namely for the purpose of sending a newsletter by e-mail, obtaining a rating or listing the company name as a reference on the website
4. Data transfer
4.1 The data will be transmitted to the following recipients:

4.2 Amazon Web Services Inc provides the infrastructure of the cloud-based application, therefore the data is stored on the servers of the data center of the AWS Cloud and sent to its use.
4.3 The Data will be transferred to these recipients for the following purposes:
Storage
Working time recording and control
(Automated) payroll accounting **
Statistical analysis (§ 46 DSG) and improvement of the application
Marketing measures, namely for sending a newsletter by e-mail, obtaining a rating or listing the company name as a reference on the website
Software development
4.4 United-Software will not disclose the collected and processed data to any third parties other than those mentioned in this declaration of consent (including other order processors) – unless there is an official or legal obligation to disclose such data – without the prior consent of the user.
5. Liability
5.1 United-Software shall be liable to the user solely from the use of the application. In this context, however, United-Software is in particular not responsible and assumes no liability for
a certain availability of the application,
the compatibility of the application with hardware or software used,
damage caused by improper operation of the user due to unsuitable hardware and software used, as well as for malfunctions that occur due to the Internet connection,
damages or disadvantages incurred by the user due to the use of the application by himself or a third party in violation of the law or the contract,
the completeness, correctness or up-to-dateness of data (especially identity data) contents, information or evaluations,
damages resulting from the loss of content, information or data,
Damages resulting from the misuse of disclosed or misappropriated data by third parties,
Damages resulting from the disclosure of confidential information by the user,
damages resulting from input errors or errors in data processing,
damages resulting from any infringement of rights (in particular competition law, copyright or other ancillary copyright personal rights).
6. Miscellaneous
6.1 The user has the option to unsubscribe from the newsletter by clicking on the unsubscribe link in the newsletter e-mail.
6.2 The User expressly consents to the disclosure of his/her data to government agencies (police, courts, authorities, protective associations or other institutions authorized to bring legal action pursuant to Section 14 of the Austrian Commercial Code) for the purpose of investigating unlawful activities of the User or the content disseminated by the User. Furthermore, the user agrees to the disclosure of personal data to third parties who certify an overriding legal interest in establishing the identity of a user. This applies in particular in the case of disclosure of data to third parties by way of a request for information pursuant to e.g. § 18 para. 4 ECG.
6.3 United-Software shall be entitled to continue to use the User’s personal data for the duration of the contractual relationship or employment relationship and to archive such data in blocked form thereafter, also for the purpose of complying with statutory retention periods, e.g. pursuant to the Austrian Federal Fiscal Code (BAO) and the Austrian Commercial Code (UGB).
6.4 Due to the system-immanent unlimited data access of the user, the user fulfills his legal obligations to provide information, to correct or to delete data on his own.
6.5 United-Software shall provide the User, at the User’s request, with the information required to monitor compliance with the obligations set out in Article 28 of the GDPR.
6.6 The above-mentioned access data will be automatically stored in the form of server log files and automatically deleted after 60 days.
7. Right of revocation
7.1 The User may revoke the declaration of consent at any time in writing by sending an email to the email address provided by United-Software in the imprint section of the United-Software website.
7.2 Such revocation of the declaration of consent shall render the further use of the data inadmissible, unless the collection, processing and transmission of the data is already permissible on the basis of relevant statutory provisions and independently of a declaration of consent. In such cases, the collection, processing and transmission of the data shall remain permissible despite revocation of this declaration.
* This data will only be collected, processed and transmitted in connection with the payroll application.
** The data will only be used for the purpose of (automated) payroll accounting if the payroll accounting application has been selected.
